Terms of Use
What Waiter POS is
Waiter POS is an app for taking orders and tracking payments in a venue (beach, restaurant, bar). It is operated by Antonio Dragan, România ("we").
By using the app you accept these terms. If you do not agree, do not use the app.
Your account and venue
The owner creates an account and a venue. Staff join with the venue code and a personal PIN. The owner is responsible for who gets access and for keeping the code private.
The data you enter (menu, orders, payments, staff names) belongs to the venue. The owner can delete the history or the whole account directly in the app. For a copy of the data, write to the address below.
Free plan and subscription
The free plan allows a limited number of orders per calendar month, menu items and crew. The current limits are shown in the app.
Waiter POS Pro is bought through the App Store as a monthly, 6-month (season) or yearly subscription. New subscribers get the first 14 days free; payment starts when they end unless the subscription was cancelled at least 24 hours before. Payment is charged to your Apple account at confirmation of purchase. The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. You manage and cancel it in your Apple account settings.
Refunds are requested from Apple, under the App Store policy.
What we do not do
The app does not issue fiscal receipts and does not replace a cash register or the venue's tax obligations. Records in the app are an internal tool.
The app is provided "as is". We make reasonable efforts to keep it working but do not guarantee uninterrupted service and are not liable for indirect losses (for example revenue not collected during an internet outage).
Our total liability to a venue is limited to what it paid for the app in the previous 12 months. This limit does not apply to intentional acts or gross negligence.
Acceptable use
Do not use the app for unlawful activity, do not try to circumvent plan limits, permissions or the service's protections, and do not access another venue's data.
We may suspend an account that breaks these terms.
Ending the service
We may discontinue the service with at least 30 days' notice, announced in the app and by email to the owner. During that time you can request a copy of the venue's data. After the service stops, the data is deleted within 30 days.
When the service stops, no new subscriptions are sold. Refunds for paid periods are requested from Apple.
Governing law
The app is intended for venues, that is, for businesses. These terms are governed by Romanian law, and disputes are settled by the competent courts in Constanța.
Changes
We may update these terms. The version in force, with its date, is the one shown in the app. Continued use after an update means you accept it.
